3. Scope and acceptance of these Terms

These General Terms and Conditions (hereinafter: the Terms) set out the terms of the contract concluded between EKONI MANUFACTURA Kft. (hereinafter: the Provider) and the customer (hereinafter: the Customer).

By placing an order or paying the deposit, the Customer declares that they have read and accept these Terms. The contract qualifies as a contract concluded in writing, is made in Hungarian, and is filed by the Provider.

4. Nature of the products – made-to-measure goods

The vast majority of the products sold by the Provider are custom-made, produced specifically for the Customer on the basis of the measurements and requirements they provide. This is an essential element of the contract, with the legal consequences detailed in the following sections (in particular regarding the right of withdrawal, see section 10).

The products are made by hand, based on historical reconstruction principles. Due to the natural raw materials used (wool, linen, leather), slight variations in colour and fabric pattern may occur; these do not constitute defective performance.

5. The ordering process

  1. The Customer contacts the Provider through the website or by e-mail (email@ekoni.hu).
  2. The Provider and the Customer agree on the product specifications, the measurements, the material and the price.
  3. The Provider sends a confirmation of the content of the order and the amount of the deposit payable.
  4. The order becomes final upon payment of the deposit.

6. Prices

The prices shown on the website are indicative; the final price of made-to-measure products is set in an individual quotation after the specifications have been agreed. Prices include value added tax but do not include shipping costs.

The Provider reserves the right to change prices; for orders already confirmed, the price stated in the confirmation applies.

7. Payment

Payment is made in two instalments:

  • Deposit: required to finalise the order; its amount is stated in the confirmation.
  • Balance and shipping cost: payable after the product is completed, by bank transfer in advance.

The parcel is dispatched only after the full purchase price has been received. The Provider issues an invoice for the payment.

8. Completion deadline

The completion deadline runs from the date the order is confirmed and depends on the complexity of the product and the current order backlog. The Provider states the expected deadline in the confirmation.

If the Provider foreseeably cannot meet the undertaken deadline, it notifies the Customer without delay.

9. Shipping and collection

The product can be received:

  • in person, at a previously agreed time, or
  • by postal or courier delivery, in the manner agreed with the Customer.

Shipping costs are borne by the Customer. The Customer must inspect the parcel on receipt; in the event of visible damage, they should ask the carrier to record a report.

10. Right of withdrawal – in the case of custom-made products

Important notice: pursuant to Section 29(1)(c) of Government Decree 45/2014 (II. 26.) on the detailed rules of contracts between consumers and businesses , the Customer is not entitled to the 14-day right of withdrawal without justification in the case of non-prefabricated goods produced on the Customer's instructions or at their express request, or goods clearly tailored to the Customer personally.

Since the Provider's products are made to the Customer's individual measurements, the statutory right of withdrawal does not apply to them.

11. The Provider's voluntary cancellation option

Notwithstanding the statutory exception above, the Provider – as a matter of goodwill – offers the following option:

  • The order may be cancelled cancelled without justification within 3 days, in which case the deposit is refunded in full.
  • After 3 days the order becomes final and the deposit is non-refundable, given that the Provider has by then already started sourcing the specific materials and cutting.

This option is a voluntary undertaking by the Provider, offering the Customer terms more favourable than the statutory minimum.

12. Providing measurements and liability

The Customer must provide accurate data and measurements. The Provider makes a measuring guide available. The Provider accepts no liability for size discrepancies resulting from incorrectly or inaccurately provided data, and any alteration needed for this reason is subject to a fee.

13. Warranty for defects, product warranty, guarantee

Warranty for defects: in the event of defective performance by the Provider, the Customer may enforce a warranty claim under the rules of the Hungarian Civil Code. The Customer must report the defect within two months of discovering it, but may no longer enforce a warranty claim after the two-year limitation period calculated from performance of the contract.

Product warranty: in the event of a defective product, the Customer may also enforce a product warranty claim against the manufacturer under the rules of the Civil Code, within two years of the product being placed on the market.

Guarantee: the legislation on mandatory guarantees does not cover made-to-measure, hand-crafted products; the Provider may undertake a voluntary guarantee in the confirmation.

The Provider publishes care information for the products on the Care guide page; it accepts no liability for damage arising from improper use or incorrect care.

14. Complaints handling and legal remedies

The Customer may submit a complaint at email@ekoni.hu or by calling +36 70 415 2434. The Provider investigates and answers the complaint within 30 days of receipt.

If the Customer does not agree with the handling of the complaint, they may turn to the following forums:

  • Fejér County Conciliation Board – 8000 Székesfehérvár, Hosszúsétatér 4–6., Hungary (competent for the Provider's registered office); phone: +36 22 510 310; email: bekeltetes@fmkik.hu; website: https://bekeltetesfejer.hu
  • Consumer protection authority – the territorially competent county government office
  • Court – in civil litigation proceedings

The Provider has an obligation to cooperate in conciliation board proceedings.

15. Data processing

Information on the processing of personal data is set out in the Privacy Policy, and information on the use of cookies in the Cookie Policy .

16. Miscellaneous provisions

Matters not regulated in these Terms are governed by Act V of 2013 on the Civil Code, Act CVIII of 2001 on electronic commerce services, and Government Decree 45/2014 (II. 26.).

The Provider is entitled to amend these Terms unilaterally; the amendment enters into force upon publication on the website and does not affect orders already confirmed.
